MahaRERA rejects broker's 2% commission claim against Arkade Developers
The Maharashtra Real Estate Regulatory Authority (MahaRERA) has dismissed a complaint filed by a real estate agent against Arkade Developers Limited. Premji Anandji Rambhia had sought a 2% brokerage fee plus interest for allegedly introducing buyers to a flat in the Arkade Aura project. The authority ruled that the claim lacked merit and fell outside its jurisdiction under RERA regulations.
Rambhia, a registered agent for the Arkade Aura project, claimed he had introduced buyers Suresh Visaria and Kunal Visaria to the developer. He demanded a 2% commission on the sale of a 4 BHK flat, along with interest. However, MahaRERA found no written agreement between Rambhia and Arkade Developers to support the brokerage claim.
The developer countered that Rambhia had initially shown the buyers a different flat configuration. Arkade Developers also denied that his involvement led to the eventual purchase. MahaRERA noted that Rambhia’s case relied heavily on an alleged oral understanding and general market practices, which were insufficient to establish a contractual obligation. Since the dispute centred on a brokerage claim rather than a violation of RERA provisions, the authority declared it could not intervene. The decision stated that Rambhia remains free to pursue the matter in a civil court if he chooses to do so.
MahaRERA’s ruling confirms that brokerage disputes without formal agreements cannot be resolved under RERA. The complainant’s request for 2% commission and interest was rejected due to lack of evidence. The authority’s decision leaves the door open for further legal action in a different forum.
