In a surprising turn of events, Frauke Brosius-Gersdorf, a candidate for the Federal Constitutional Court, has withdrawn her nomination, primarily due to strong opposition from the conservative CDU faction.

Brosius-Gersdorf's candidacy had been contentious, with her progressive stances on issues such as late-term abortion rights and the banning of the far-right AfD party fueling resistance from conservatives and some Catholic groups.

The Vice-Chancellor, Lars Klingbeil, explained that there has always been a broad consensus among parliamentary groups to nominate, elect, and make decisions on judges together. However, the dispute over Brosius-Gersdorf’s positions made cross-party agreement impossible, prolonging the stalemate and intensifying debates about the politicization of the Constitutional Court appointments.

Brosius-Gersdorf stated that the rejection had made her election impossible and that she was "no longer available for election as a judge of the Federal Constitutional Court." She also thanked the SPD parliamentary group for standing by her until the end. Klingbeil, in turn, respected her personal decision to withdraw.

The judicial election for three positions at the Federal Constitutional Court failed in the Bundestag due to the refusal.
