Website perspective on the progress of Troubles Legacy Framework: A significant stride, yet execution is crucial
The Irish and British governments have reached an agreement on a new framework for addressing the legacy of the Troubles, a significant step towards resetting relations between Dublin and London. This new plan replaces the Independent Commission for Reconciliation and Information Recovery (ICRIR) established under the Legacy Act.
The new framework aims to provide a route for families to gain some closure, as it restarts inquests and lifts the ban on prosecutions relating to deaths during the Troubles. Two new bodies will be established under the new framework, capable of conducting fact-finding inquiries and recommending criminal prosecutions.
One of these bodies will be a dedicated Garda unit established by the Irish Government to support historical investigations related to the Troubles. This unit is expected to play a crucial role in helping with historical investigations, aiding in the pursuit of justice for victims and their families.
In addition, a fund will be created in Ireland to help witnesses meet the costs involved in the investigations. This measure is intended to ensure that no one is deterred from coming forward due to financial constraints.
However, it is yet to be seen how the new protections for army veterans will impact legal cases, fact-finding inquiries, and inquests. The agreement has been met with opposition from all sides in Northern Ireland, and the Belfast High Court found it to be in breach of European human rights law.
The previous Irish government took a rare interstate case against the Legacy Act, demonstrating the contentious nature of the issue. Despite these challenges, the new framework stands a better chance of success compared to the unilateral imposition of the Legacy Act by the previous London government.
The new framework is awaited by families of victims to see it in practice. It is hoped that this agreement will mark a significant step towards addressing the legacy of the Troubles and bringing some closure to those affected by the conflict.
