In a recent court ruling, Judge Suzanne Courchesne found Pierre Hugues Boisvenu, a former legislator, guilty of kissing Sylvia Ribeyro without her consent, which constitutes a non-consensual sexual contact, or sexual assault. The incident occurred on January 3, 2013, following a visit by Boisvenu to Ribeyro's residence. The judge, however, was not convinced by the testimony regarding hands on the buttocks, frottements, and the attempt to lift the skirt. Ribeyro's testimony was perceived as somewhat theatrical, and her tears were questioned for authenticity. Boisvenu, who founded the Association of Families of Murdered or Disappeared Persons (AFPAD) in 2004, apologised to Ribeyro a few minutes after the incident. Despite this, he filed a $250,000 civil lawsuit against Ribeyro for defamation in response to her online texts about a senator. Ribeyro, the woman who was kissed without consent by Boisvenu, calculated the number of times she set her limits in the incident. Boisvenu's testimony was found to be vague and contradictory, which damages the credibility of his account. The non-consensual kiss with the tongue has had negative effects on Ribeyro, including weight gain, frequent crying, fear of men, flashbacks, feelings of shame and disgust, and symptoms of post-traumatic stress disorder. Boisvenu also described similar symptoms, seeking $300,000 in damages, including moral, pecuniary, punitive damages, and the reimbursement of extrajudicial fees and legal costs. In a surprising turn of events, Boisvenu was ordered to pay $19,000 to Ribeyro. Boisvenu left his position as senator in February 2024 upon reaching the mandatory retirement age of 75. The current residence of Ribeyro is not publicly disclosed. Boisvenu and Ribeyro knew each other due to their shared mission of protecting the rights of crime victims. It is important to note that Boisvenu's daughter was kidnapped, raped, and murdered by a repeat offender in 2002, an event that has significantly impacted his life and work. This tragic incident, however, does not excuse the actions for which he has been found guilty. This case serves as a reminder of the importance of consent in all interactions and the consequences that can arise when it is not respected.
