LATEST: The Court of Appeal has stood by its decision to acquit businessman and former Rural Development Ministry secretary-general, Datuk Dr Abdul Aziz Muhammad, in two separate cases of abetment in criminal breach of trust (CBT) and cheating.

Justices Datuk Suriyadi Halim Omar, Datuk Hasan Lah, and Datuk Ahmad Maarop collectively turned down the prosecution's appeal against the acquittal.

In 2005, Aziz, now 65, was found guilty and served five years in prison for aiding Terengganu Tengah Development Authority (Ketengah) general manager Datuk Alwi Said in misusing RM2 million from Ketengah. The supposed wrongdoing occurred at Kompleks Kewangan in Jalan Raja Chulan from April 27 to July 31, 1999.

Additionally, Aziz was sentenced to another five years for misleading the second Finance Minister, Datuk Mustapa Mohamed, via Finance Ministry officials, into thinking Ketengah's RM9 million investments in orchid cultivation, aquaculture, and recreational projects in Tasik Puteri, Bukit Besi, Dungun, were legitimate. These activities were believed to have taken place at the Finance Ministry in Kuala Lumpur between June 24 and August 9, 1999.

In 2008, the High Court acquitted and discharged Aziz after allowing his appeal; he was instructed to serve the sentences concurrently. - Bernama
