Vaccine Mandates for Workers: A Changing Landscape

In an attempt to facilitate a return to the office and boost vaccination rates, several major companies, including United Airlines, Google, Facebook, Tyson Foods, Equinox, Walmart, and Disney, are contemplating making vaccinations mandatory for some employees. This trend is in response to the escalating Covid-19 cases, particularly as more contagious variants emerge.

CNN Business also revealed that WarnerMedia will require COVID-19 vaccination proof for US office building access starting September 6. This shift in company policies highlights the increasing consideration given to vaccines as a safety measure in the workplace.

However, the landscape of vaccine mandates for employees is intricate and varies between sectors and jurisdictions. The Supreme Court has issued preliminary stays on some federal mandates, such as the Occupational Safety and Health Administration’s (OSHA) Vaccination or Test Emergency Temporary Standard (ETS), which would have required employers with 100 or more employees to implement a vaccine mandate or regular testing for unvaccinated workers.

Furthermore, the Centers for Medicare and Medicaid Services (CMS) Omnibus Health Care Staff Vaccination rule, affecting health care providers in 24 states, has been temporarily blocked by the Supreme Court. Despite these setbacks, many companies continue to implement voluntary vaccine mandates or opt for regular testing or other protective measures.

It's essential to note that the federal mandate situation is fluid, and entities are advised to monitor ongoing legal proceedings. As for schools, while no states currently mandate COVID-19 vaccines for students, some proposals have met resistance from parents.

The decision to require vaccines or implement alternative measures ultimately depends on each company's specific circumstances and the evolving legal environment.
