Utilization of cellphones smuggled into prisons in Mandaue
In an aim to tighten jail rules and deter unlawful activities, the Mandaue City Council has proposed a new ordinance to outlaw the unauthorized use, possession, or introduction of mobile phones and other electronic communication devices within the city's correctional facilities.
Councilman Oscar Del Castillo Jr. put forward this legislation as a response to the escalating issues related to these devices. He expressed, "As of now, there's no ordinance in place, but reminders aren't heeded. It's forbidden, but no one pays attention."
Previously, phones were tolerated in prisons under certain internal policies, but without the legal backing, they were easily overlooked. However, should this ordinance come into effect, offenders, visitors, and even jail officers would be held accountable with fines of up to PHP 5,000 for the first month.
The ordinance also extends the ban to anyone, excluding authorized personnel, participating in emergency communications, electronic visitations, or online court hearings. Personal and staff devices must be declared upon entry, detailing brand, type, and description for thorough documentation.
Only authorized personnel will be allowed to assign, register, and monitor approved devices.
Even though devices will be subject to inspection and vary depending on whether the individual is an inmate, visitor, or staff member, there are still potential loopholes such as smuggling devices, loss of benefits, or opportunities for bribery.
This ordinance is set to be posted on the City Hall bulletin board and local newspapers within 15 days of its approval.
