US launches IP investigation into Viet Nam's trade practices

The United States has launched an investigation into Viet Nam’s handling of intellectual property (IP) protection. The move comes after the US Trade Representative labelled the country a 'Priority Foreign Country' in its latest report. Viet Nam has responded by urging a fair assessment of its recent reforms and enforcement efforts. On 29 May 2026, the US Trade Representative announced a formal probe under Section 301 of the US Trade Act of 1974. The investigation will scrutinise Viet Nam’s policies, practices, and enforcement related to intellectual property. Officials will determine whether these measures unfairly burden or restrict US businesses.

The US decision follows long-standing concerns over IP violations in Viet Nam. Despite this, the country has taken steps to tighten its legal framework in recent years. New regulations and enforcement campaigns have targeted smuggling, trade fraud, and counterfeit goods. Viet Nam’s government has also issued key directives to strengthen IP protection. These include Prime Ministerial Directive No. 02/CT-TTg and a national programme to combat fakes and protect e-commerce consumers. Authorities have additionally partnered with global tech firms and digital platforms to detect and address IP breaches. In response to the US investigation, Viet Nam has called for an objective evaluation. The government emphasised its commitment to transparency, innovation, and fulfilling international IP obligations.

The US Trade Representative will finalise its findings after consulting with President Donald Trump. A decision will then be made on whether further action is needed. Viet Nam continues to push for stronger IP enforcement while engaging with international partners on trade concerns.
