In a Tennessee courtroom this week, Kilmar Abrego Garcia, wrongly deported to his native El Salvador back in March, faced federal charges for allegedly transporting undocumented immigrants across the US. Over two months after the blunder by the Trump administration, an indictment revealed that he'd been part of a long-term scheme to smuggle people from Texas to various US locations, making over a hundred trips and dealing with rival gang members.

Once back in the US, Abrego Garcia stood before a judge in the Middle District of Tennessee, confirming his understanding of the charges against him. His court date has been set for June 13, where he'll be arraigned and face potential pre-trial detention due to the government's claim that he poses a risk to the community and a high flight risk. With a maximum prison term of ten years for each alien he transported, if convicted, Abrego Garcia faces some considerable time behind bars.

His attorney, Simon Sandoval-Moshenberg, dismissed the allegations as an abuse of power, stating that the administration was simply trying to cover up their error in deporting him in the first place. The lawyer promised a vigorous defense for his client. Interestingly, the sudden indictment and charges led to the abrupt departure of Ben Schrader, a high-ranking federal prosecutor in Tennessee, who reportedly resigned because of concerns that the case was being pursued for political reasons.

The conspiracy, spanning nearly a decade, allegedly involved the movement of thousands of noncitizens, including children, for thousands of dollars. While Abrego Garcia is the only one charged, sources suggest that members of the Salvadoran gang MS-13 were among those transported. Despite his attorney's claims, it's rumored that one of Abrego Garcia's co-conspirators told authorities that he participated in the murder of a rival gang member's mother in El Salvador.

Pam Bondi, the Attorney General, praised the cooperation of El Salvador in returning Abrego Garcia to the US and emphasized that if found guilty, he'd be deported back to his home country upon completion of his sentence. As of now, Abrego Garcia remains in federal custody in Tennessee, awaiting his next court appearance.

This criminal investigation began following a 2022 traffic stop by the Tennessee Highway Patrol, which ultimately allowed Abrego Garcia to drive on with only a warning about his expired driver's license, despite their suspicions about human smuggling. Since then, Abrego Garcia has been transferred from El Salvador's notorious CECOT prison to a different facility in the country before being brought back to the US. While some may see this development as putting an end to the ongoing civil case in Maryland that had ordered the government to facilitate Abrego Garcia's return, the Deputy Attorney General remains unsure.

After a series of legal battles, the Supreme Court ordered the Trump administration to bring Abrego Garcia back to the US.
