Harvey Weinstein, the disgraced film producer, is set to face a third trial in New York later this year, accused of raping actress Jessica Mann in 2013. The retrial is expected to happen in the fall, if it proceeds, or Weinstein could be sentenced on other convictions by late September 2025.

The jury in the June 2025 trial was deadlocked on the rape charge involving Mann, though they did convict Weinstein on a separate charge. Manhattan prosecutors have expressed a strong desire to retry Weinstein on the rape charge, emphasizing the need to deliver a verdict for Mann’s claims.

Weinstein's legal team, however, opposes a plea deal that would admit guilt to raping Mann and is pushing to dismiss the charge instead. The charge carries a maximum prison sentence of up to four years, which is less time than Weinstein has already served.

Weinstein is currently incarcerated in New York, having previously been sentenced to 16 years in prison in California for another case. He has denied all allegations of sexual assault against him.

The sentencing for the guilty verdict in the Miriam Haley case, a separate trial, is scheduled for September 30. However, it is subject to change if Weinstein pleads guilty, the prosecutor’s office drops the charges, or the trial takes place before the end of September.

This third trial would mark Weinstein’s third New York trial and fourth overall, all stemming from multiple sexual assault allegations that surfaced prominently during the #MeToo movement. It is important to note that Weinstein's conviction from 2020 was overturned in 2024, and a new trial was ordered.

Weinstein's legal team has stated that he will not plead guilty, and a lawyer for Weinstein has announced this decision. The trial is expected to take place before the end of the year, as announced by New York judge Curtis Farber on Wednesday.
