New Zealand is set to expand open work rights for partners of migrant workers from December 2, 2024. This change will affect partners of Accredited Employer Work Visa (AEWV) holders, Essential Skills work visa holders, and partners in certain ANZSCO Levels 4-5 roles.

For most cases, the wage threshold for open work rights is NZD $25.29 per hour. However, for certain roles and sectors, the threshold may be higher. Partners of AEWV holders employed in roles classified under ANZSCO Levels 1-3, earning at least NZD $25.29 per hour, will receive open work rights.

Partners of AEWV holders in ANZSCO Levels 4-5 roles may qualify for open work rights if they earn at least $47.41 per hour, meet certain criteria for roles in the Green List, or meet criteria for roles in the Transport or Care Sector Agreements or the specified sector agreement wage, whichever is higher.

Partners of Essential Skills work visa holders earning at least $25.29 per hour will also receive open work rights. It is worth noting that partners of AEWV holders already supporting a partner for a work visa as of June 26, 2024, earning at least $25.29 per hour, will also receive open work rights.
