The 2000 merger agreement mandates that the removal of Ben & Jerry's CEO can only occur after consulting with an independent advisory committee of the company's board.

According to Ben & Jerry's, Unilever's recent interventions have reached a "new level of suppression." In February, the multinational corporation prevented Ben & Jerry's from honoring Black History Month, and more recently, prohibited them from advocating for the release of Mahmoud Khalil - a U.S. resident facing deportation under the Trump administration.

Initially, both Unilever and Ben & Jerry's were unavailable for comment regarding the CEO's dismissal. Dave Stever has been CEO since May 2023, and has worked at the company since 1988, starting as a tour guide. It remains uncertain whether he continues to be employed by Ben & Jerry's.

This is not the first legal battle between the two companies. In 2022, Ben & Jerry's sued Unilever over the halt of its decision to stop selling in the occupied West Bank, but the request was dismissed by a federal judge.

The lawsuit against Unilever is ongoing, with Ben & Jerry's aiming to address what it perceives as a violation of its autonomy and social mission under the merger agreement.
