In the midst of a whirlwind of controversy, Kilmar Abrego Garcia, a 29-year-old immigrant from El Salvador, has made his way back to the United States after a harrowing deportation. His return follows an intense legal battle that's caught the attention of politicians and the public alike.

Kilmar Abrego Garcia, who previously resided in the US, was given the boot in March, only to find himself in his homeland of El Salvador. Deciding to take a stand, Abrego Garcia launched a relentless legal crusade to regain his freedom.

Despite having a work permit, the man was arrested and transported to El Salvador. The U.S. Justice Department confirmed Abrego Garcia's return to the States on Friday, attributing it to an arrest warrant presented to Salvadoran authorities.

Abrego Garcia faced a barrage of charges including human smuggling and allegedly transporting minors, children, weapons, and drugs. U.S. Attorney General Pam Bondi insists that should he be convicted, Abrego Garcia should serve out his sentence in the States and face deportation once more.

Abrego Garcia has appeared in a federal court in Tennessee, with charges based on a two-count indictment. The indictment alleges that Abrego Garcia made more than one hundred trips between Texas and Maryland between 2016 and 2025, smuggling migrants in the process.

Trumps Verdict

Controversy erupted when Donald Trump weighed in on the matter, stating that Abrego Garcia had a “horrible past.” Alleging the decision to bring him back was by the Justice Department to showcase his criminal history, the former President seemed pleased with the outcome.

Abrego Garcia's legal representative, Simon Sandoval-Moshenberg, disputes the U.S. government's claims, labeling the indictment as “pure invention” and a “hodgepodge of allegations.” Sandoval-Moshenberg also criticized the sources of these claims, noting that they are either facing criminal charges or are currently detained.

Abrego Garcia's case stokes the flames of a broader discussion surrounding the Trump administrations approach to deportations. At the heart of the dispute is the question of whether those affected receive sufficient legal due process. Previously, Abrego Garcia was part of a larger group of migrants, mainly from Venezuela, who were deported from the U.S. approximately three months ago. The majority were sent to the notorious El Salvadorian prison, Centro de Confinamiento del Terrorismo (Cecot).

The Road to Return

Abrego Garcia claims that he entered the US as a teenager around 2011, fleeing gang violence in El Salvador. Despite a denied asylum application in 2019, the Salvadoran father was granted protection from deportation to his home country and even received a work permit. However, he was arrested in the state of Maryland in mid-March and deported shortly after.

Initially, the U.S. government attributed the deportation to an administrative error but continued to assert that Abrego Garcia was himself a member of the notorious MS-13 gang. However, Abrego Garcia's lawyers have vehemently denied these claims.

Ultimately, a federal judge ordered Trump's government to return Abrego Garcia to the U.S., making its way to the Supreme Court of the United States where a heated legal tussle ensued. The Trump administration argued that the return was essentially out of their hands, resting with the Salvadoran government instead.

President of El Salvador, Nayib Bukele, has expressed cooperation with the Trump administration, asserting that if they demand the return of a gang member for prosecution, El Salvador would comply.
