His deportation, initially acknowledged as an error, subsequently became a defiant act against the courts' orders to facilitate his return to the US.

U.S. officials presented El Salvador President Nayib Bukele with an arrest warrant for federal charges in Tennessee, accusing Abrego Garcia of being a key player in a large-scale human smuggling operation. He is expected to stand trial in the U.S. and, if convicted, will be sent back to his native country of El Salvador at the conclusion of the case.

Disputed Circumstances

The case has also reportedly led to the resignation of a top supervisor in the U.S. attorney's office in Nashville. The witness testimony and evidence presented in the indictment, unsealed in June 2025, accuses Abrego Garcia of smuggling thousands of immigrants, including children and members of gangs, from Central America into the U.S. for a fee.

Regardless of the outcome of the trial, Abrego Garcia's immigration court case would still need to be reopened if the Trump administration wished to deport him to El Salvador, as his feared persecution by local gangs provides protection under U.S. law.
