Twitter Delaying Enforcement of Accounts on TikTok Platform
On September 16, 2025, President Donald J. Trump issued an order at the White House, extending the enforcement delay on the Protecting Americans from Foreign Adversary Controlled Applications Act (PAFACAA). This order affects the Department of Justice (DoJ) and the Office of Management and Budget (OMB) in their functions related to budgetary, administrative, or legislative proposals.
The Attorney General is tasked with preserving and defending the Executive's exclusive authority to enforce PAFACAA, as section 2(d) of the Act vests this authority solely in the Attorney General. The DoJ is instructed not to take any action to enforce the Act or impose penalties after the expiration of the extension period for conduct that occurred during the extension or any prior period.
During the extension period, the DoJ will not enforce the Act or impose penalties against any entity for noncompliance with the Act. The Attorney General is also instructed to issue letters to providers stating that there has been no violation of the statute and no liability for conduct during the extension period or from the Act's effective date until the order's date.
The Attorney General is still directed to issue written guidance to implement the provisions of the extension, and to issue letters to providers as previously mentioned. Attempted enforcement by states or private parties is still considered an encroachment on the powers of the Executive.
It's important to note that this order does not affect the authority granted by law to an executive department or agency, or the head thereof. Furthermore, nothing in the order is intended to affect the aforementioned authority. The costs for the publication of this order are borne by the Department of Justice.
The enforcement delay on PAFACAA as it pertains to TikTok, originally set by Executive Order 14166 in 2025, is extended until December 16, 2025. This order is to be implemented in accordance with applicable law and subject to the availability of appropriations.
The search results do not provide information about which government body is responsible for the investigation and enforcement of PAFACAA, beyond the Attorney General and the Department of Justice. The Attorney General is still tasked with preserving and defending the Executive's exclusive authority to enforce PAFACAA. This order does not create any rights or benefits enforceable at law or in equity by any party.
