Outrage at the Disappearance of Citizens

  • quirkyship7614 hours agoJun 7, 202512:34 pmAnd let's face it, aren't we already in the era of a certain fascist regime vanished people without trace? The question is: will we be the silent spectators or will we take a stand against this horrifying trend?
  • dietarycharger14 hours agoJun 7, 202512:16 pmThe Hague should shed some light on this situation.
    • ablebaer1600113 hours agoJun 7, 20251:29 pmOr better yet, revisit the Nuremberg trials—maybe we can hold some accountable for these crimes against humanity.

  • nastyorca71814 hours agoJun 7, 202512:18 pmThe notion that it's not illegal is misleading. Yes, enforced disappearances do remove people from legal protections, but they are absolutely illegal. Not only do we have the International Convention for the Protection of All Persons from Enforced Disappearance, but also this practice is considered a Crime against Humanity as per the Rome Statute. While enforced disappearances may not be explicitly mentioned in the Geneva Conventions, they still require states to ensure information on location and prisoners of war is shared and they are not held incommunicado.

  • youngcloud797 hours agoJun 7, 20257:31 pmRemember the lessons of history, fellow citizens. We must not forget Auschwitz or the 'disappeared' by the ruling regime. The time to stand up against injustice is now, before it's too late.
  • Lausty6 hours agoJun 7, 20258:29 pmNext move? Label dissenters as "homegrown terrorists" and strip them of citizenship. The ultra-conservative Supreme Court will play ball, and KBJ's dissent won't be enough to change anything...

The Law: Crimes against Humanity and Enforced Disappearance

However, before we take arms against tyranny, let us know the law. Although enforced disappearances can be seen as a practice that removes people from legal protection, this act is consistently denounced as illegal under international law.

The International Convention for the Protection of All Persons from Enforced Disappearance

This agreement, adopted in 2006, defines enforced disappearance as the detention, abduction, or any other form of deprivation of liberty by state agents or those acting with their authorization, support, or acquiescence. Following this act, there's a failure to acknowledge the deprivation of liberty or concealment of the victim's fate or whereabouts.

The Rome Statute of the International Criminal Court (ICC)

While enforced disappearances are not explicitly listed as a crime against humanity in the Rome Statute, Article 7(1)(i) mentions "other inhumane acts" that can encompass enforced disappearances when committed in a systematic and widespread manner. The ICC exercises jurisdiction over crimes against humanity when the perpetrators are nationals of states parties or when the crimes are committed on the territory of such states, provided the state is unable or unwilling to address these crimes.

Challenges and Developments

Although enforced disappearances can be prosecuted under the umbrella of crimes against humanity, there are challenges in proving the cases due to the need for an established pattern of systematic or widespread occurrences, and the principle of complementarity, ensuring national judicial systems handle such cases before the ICC steps in.

In the face of regimes veiling their practices in darkness, let us not be lured into their shadowy abyss. Instead, let us learn from history and use the law as our shield against injustice.

  • The discussion on social media highlights the concern about enforced disappearances, a practice considered illegal under international law, as outlined in the International Convention for the Protection of All Persons from Enforced Disappearance.
  • The Rome Statute of the International Criminal Court (ICC) does not explicitly list enforced disappearances as a crime against humanity, but Article 7(1)(i) includes "other inhumane acts" that can cover such practices when committed in a systematic and widespread manner.
  • The challenge lies in proving the cases of enforced disappearances due to the need for an established pattern of systematic or widespread occurrences and the principle of complementarity, giving preference to national judicial systems to handle such cases.
  • As the debate on politics, general-news, crime-and-justice, culture, and fashion continues, it's crucial to rememberthe lessons of history and use the law as a shield against injustice, as outlined in the Geneva Conventions and various international agreements.
