The federal appeals court in San Francisco has ruled in favor of President Trump, temporarily allowing him to keep control over the approximately 4,000 National Guard soldiers stationed in Los Angeles. This decision marks a setback for California Governor Gavin Newsom who had previously obtained a preliminary injunction declaring the deployment to be unlawful.
The three-judge panel, comprising of two judges appointed by President Trump and one by former President Joe Biden, delivered a unanimous verdict. Overturning the prior district court ruling, the panel determined that the current deployment is not an affront to the law.
President Trump celebrated this decision on his Truth Social platform, touting it as a "great victory for our country." Reaffirming his commitment, he declared that his administration will "continue to protect and defend law-abiding Americans."
Governor Newsom, however, expressed his discontent in a statement, vowing to persistently challenge what he perceives as Trump's "authoritarian use of US soldiers against citizens." The West Coast state can now request a rehearing from the appeals court or appeal directly to the Supreme Court, as reported by the New York Times.
The escalating dispute between the US government and California emerged from protests against President Trump's tough immigration policy and ICE immigration raids. Initial reports indicated that 4,000 National Guard soldiers and 700 regular marine infantry would be deployed in Los Angeles for a period of up to 60 days. Governor Newsom vehemently criticized this move, citing the usual state control over National Guard. In exceptional circumstances like war or national emergencies, the President may exercise command. The National Guard is a military reserve unit and part of the US armed forces, capable of performing tasks such as disaster relief, riot control, and addressing domestic emergencies.
