Trump petitions U.S. Supreme Court for expedited action to exclude Lisa Cook from Federal board position

In a recent development, the Trump administration has appealed to the U.S. Supreme Court for an emergency order to remove Lisa Cook, a member of the U.S. Federal Reserve's board of governors. This request comes after a federal appeals court in Washington rejected the administration's earlier attempt to let Cook's removal proceed.

Cook, who was appointed to the Fed's board by President Joe Biden, joined the board in 2022. Prior to this, she had taken part in a vote where the Fed cut its key interest rate by a quarter-point, along with Stephen Miran, Trump's nominee who was confirmed by Senate Republicans to an open spot on the Fed's board.

The administration's request for Cook's removal stems from allegations of mortgage fraud that Trump has levelled against her. However, Cook has denied any wrongdoing and has not been charged with a crime.

The Trump administration's case for Cook's removal was previously dismissed by U.S. District Judge Jia Cobb, who ruled that the administration had not satisfied the legal requirement for firing a Fed governor "for cause." Cobb also held that Trump's firing of Cook would have deprived her of her due process.

The Supreme Court has distinguished the Federal Reserve from other federal agencies, suggesting that Trump cannot act against Fed governors without cause. This decision was based on the fact that the previous firings initiated by Trump were at will, with no cause given.

The administration is also seeking a more lasting order from the whole court that would be in place while Cook's legal case continues. Trump's lawyers argue that Cook's alleged action "indisputably calls into question Cook's trustworthiness and whether she can be a responsible steward of the interest rates and economy."

The person Trump wanted to remove from office on August 25, 2021, before she officially took office, was Lisa Cook. Documents obtained by The Associated Press suggest that Cook did specify that her Atlanta condo was a "vacation home."

The request to the Supreme Court comes after an appeals court refused to oust Cook. Last week, a federal judge ruled that the removal of Cook was probably illegal and reinstated her to the Fed's board. The administration is now asking Chief Justice John Roberts for a temporary order to effectively remove Cook from the board.
