The legal threat is based on statements Hunter Biden made in a YouTube interview with journalist Andrew Callaghan in early August 2025.

Biden alleged, "Epstein introduced Melania to Trump. The connections are, like, so wide and deep," attributing the claim to author Michael Wolff. These statements, according to Melania Trump's attorney, Alejandro Brito, are "false, defamatory, disparaging, and inflammatory," causing the first lady "overwhelming financial and reputational harm."

Brito sent a letter dated August 6, 2025, to Hunter Biden and his attorney, demanding that he immediately retract and apologize for the claims or face legal action seeking damages exceeding $1 billion. However, Biden has refused to retract or apologize, reiterating his belief in the connections between Epstein and the Trumps and citing Wolff's book as partial support for his claims.

It is important to note that Melania Trump and Donald Trump have consistently maintained that she was introduced to Donald Trump by modeling agent Paolo Zampolli at a 1998 New York Fashion Week event, not Epstein.

The evidence behind the lawsuit threat is centered on Hunter Biden's repeated public claims linking Melania Trump to Epstein, which her legal team demands be retracted as defamatory. The case hinges on the factual accuracy of those claims and their impact on Melania Trump's reputation.
