In a significant turn of events, the Federal Court of Justice (BGH) in Karlsruhe has overturned the initial verdict issued by the Regional Court (Landgericht) in Würzburg, regarding the fatal knife stabbings that occurred in front of a local club.

The Regional Court had convicted the defendant of murder, likely based on the assumption that the stabbing was carried out with intent to kill.

The Federal Court of Justice has revised this decision and reclassified the defendant’s act from murder to manslaughter or a lesser form of unlawful killing. The BGH concluded that the requirements for murder, such as specific intent (Mordmerkmal), were not sufficiently proven or were misinterpreted. This meant the act did not meet the strict legal criteria for murder but still constituted an unlawful killing under a different classification.

This marks the third case related to the knife stabbing incident, where a man stabbed one club-goer to death and injured two other men with the same knife in September 2023.

The case will now be retried by another jury chamber of the Regional Court, as the initial court could not precisely determine what happened next. The Public Prosecutor's Office and co-plaintiffs appealed to the Federal Court of Justice, and their appeals were successful. The location of the initial trial was in Würzburg, while the Federal Court of Justice is situated in Karlsruhe.

The Federal Court of Justice ruled that it was possible the alleged perpetrator believed he was in a self-defense situation, just before the first knife stab. During the altercation, the man's eardrum was torn. The verdict was overturned by the Federal Court of Justice, and the case will now be re-evaluated based on the new findings and interpretations of the law.
