Third Trial for Harvey Weinstein in New York Following Reversal of Previous Sexual Assault Trial

In a recent court hearing, Judge Curtis Farber announced that Harvey Weinstein, the former Hollywood producer, will face a third trial in New York for the sexual assault case involving actress Jessica Mann. The trial is scheduled to take place in the fall of 2025, ahead of the planned September 30 sentencing hearing for a separate conviction.

The announcement comes after a June 2022 mistrial where the jury was unable to reach a verdict on the rape charge against Weinstein related to Jessica Mann. Judge Farber stated that he could sentence Weinstein on the separate conviction on September 30, 2025, but only if the retrial against Mann does not proceed.

Prosecutors and Mann are ready to proceed with the retrial, and the judge emphasized the need to have the case resolved within 2025. Weinstein has denied all charges and is currently held in custody in New York. He was previously convicted in a 2020 trial whose verdict was overturned, leading to this retrial opportunity.

During the hearing, Weinstein was seen in a wheelchair, dressed in a navy blue suit with a pale face. His controversial lawyer, Arthur Aidala, stated outside the court that Weinstein does not intend to plead guilty to the sexual assault of Jessica Mann.

Weinstein's lawyer also mentioned that his client is currently receiving treatments for cancer, heart conditions, diabetes, and various back problems. He suggested that Weinstein's treatments would be easier if he were not detained at Rikers Island. The date for the third trial has yet to be specified.

It is important to note that this ruling does not affect the verdict finding Weinstein guilty of sexually assaulting production assistant Miriam Haley in 2006. Weinstein's case sparked the #MeToo movement on an international scale in 2017.
