The Supreme Court of India has rebuked Rahul Gandhi, the Leader of Opposition, for his alleged derogatory and disparaging remarks about the Indian Army regarding the 2020 Galwan Valley clash with China.
The controversy began during Rahul Gandhi's Bharat Jodo Yatra in December 2022, when Udai Shanker Srivastava, a retired Border Roads Organisation official, filed a criminal defamation complaint against him. Srivastava alleged that Gandhi made derogatory remarks about the Indian Army, claiming that China had occupied 2000 square kilometers of Indian territory and criticizing the handling of the Galwan clash.
The complaint triggered legal proceedings, and the Allahabad High Court dismissed Gandhi's plea challenging his summons, deeming the complaint maintainable.
The Supreme Court, presided over by Justices Dipankar Datta and Augustine George Masih, has now intervened. In a strong rebuke, Justice Dutta stated, "If you were a true Indian, you would not say all this." The court also questioned Gandhi's evidence for his claims about Chinese land occupation and asked for any credible material he had to support his allegations.
The Supreme Court has stayed the defamation proceedings temporarily, advising Gandhi, as Leader of Opposition, to raise such issues in Parliament rather than on social media or public fora.
The court's intervention comes as a response to Gandhi's challenge of the summons, arguing it was a politically motivated move and was lodged in a mala fide manner. However, the court expressed disapproval of Gandhi's alleged comments, stating that they were not in the best interest of the nation.
The Supreme Court has issued a notice to the Uttar Pradesh Government and the complainant, Udai Shanker Srivastava, in the case. The proceedings are ongoing, and it remains to be seen how this will impact Rahul Gandhi and his political career.
