Controversy Surrounding Giusi Bartolozzi and Osama Almasri Case

In the heart of a political storm, Giusi Bartolozzi, the Chief of Staff to the Italian Minister of Justice, Carlo Nordio, finds herself at the centre of a controversy involving the release of Libyan general Osama Almasri, wanted for war crimes.

The controversy began when Almasri was stopped by the police in Turin on the evening of January 18. The documents related to his case were transmitted through the Ministry of Foreign Affairs and specifically through the embassies. These documents, initially uploaded to the Prisma platform, could only be opened by the diplomatic advisor to the Minister of Justice.

Luigi Birritteri, the former head of the Department of Justice, emailed Giusi Bartolozzi about the possibility of Minister Nordio performing "an urgent act" to keep Almasri in prison. However, it seems that Bartolozzi did not make any reference to the "urgent" acts solicited by Birritteri in her response.

Bartolozzi's involvement in the case is controversial but not officially confirmed in investigation documents. Alessandro Sutera Sardo, the judicial liaison magistrate, uploaded the documents to the Prisma platform, and Sutera Sardo also informally alerted his Italian colleagues about the documents.

The National Association of Magistrates (ANM), led by its president Cesare Parodi, has publicly commented on the political repercussions that would follow if Bartolozzi were investigated or prosecuted for her role in the Almasri case. Parodi suggested that such a trial would have political consequences affecting those involved.

This statement provoked a strong reaction from Carlo Nordio, the Minister of Justice and Bartolozzi’s direct superior. Nordio expressed outrage, calling Parodi’s comments an unacceptable overreach and an improper intrusion into institutional prerogatives. He disputed that Bartolozzi’s name appears in the official investigation documents, suggesting Parodi might have access to confidential information if he mentioned her.

The Court of Ministers has dismissed the case against the Prime Minister, but Nordio and the Minister of the Interior, Matteo Piantedosi, remain under investigation. The international arrest warrant for Almasri was issued by the court in The Hague.
