The INE's New Judicial Selection Process

Get ready for the 861 majority certificates! The National Electoral Institute (INE) is all set to hand over the certificates to the winners vying for positions in the Federal Judiciary (PJF) come September 1st. Before doing so, the institute will conduct an aptitude review, ensuring that the most eligible candidates take office.

Counselor Carla Humphrey has emphasized that this analysis will follow review criteria and gender adjustments, ensure compliance with legal provisions, and uphold established principles.

In the upcoming weeks, the so-called "8 of 8 plus two" rules will be implemented. First, eligible candidates will be determined in a session, followed by their summons in stages. The INE will also examine 26 cases scrutinized by Congress, aiming to filter out unfit candidates.

Although 13 cases appear to have no red flags so far, an additional filter will be applied to ensure that the selected candidates are constitutionally allowed to occupy a position in the Judiciary, taking into account various impediments such as intrafamily violence or having a firm sentence for a crime resulting in imprisonment.

The INE has prioritized enforcing gender parity rules, established before the election, to guarantee equitable representation between men and women in Judiciary positions. These provisions will be implemented during the certificate delivery process, which is scheduled for June 15th, granting ample time to address any potential appeals before September 1st.

The INE strives to foster confidence in democratic processes and maintain that public positions are filled with individuals meeting the necessary legal and ethical requirements.

Enrichment Data

In Mexico, the INE's new judicial selection process involves aptitude reviews and popular elections for candidates to the Federal Judiciary. The review criteria encompass vetting by Evaluation Committees, professional and legal suitability, prohibition of party affiliations and funding, and campaign restrictions. However, specific gender-based adjustments or quotas are not explicitly detailed in the current process. The Organization of American States recommends strengthening civic education and promoting diversity for a fairer representation of the population, but does not detail gender-specific mechanisms for the aptitude review phase.

The new judicial selection process by the INE, set to be implemented in the upcoming weeks, includes an aptitude review that checks professional and legal suitability, adheres to gender parity, and ensures compliance with legal provisions. The INE's initiative aims to maintain public confidence in democratic processes, appointing individuals who meet the necessary legal and ethical requirements.
