Syrian individuals not all granted asylum eligibility
The Administrative Court of Cologne has confirmed the Federal Office for Migration and Refugees (Bamf) decision to reject a Syrian citizen's asylum application in Germany. The court's announcement was made on Wednesday, April 2025.
The Syrian in question hails from northeastern Syria, a region currently under Kurdish control. The court's decision does not indicate that the Syrian is threatened with persecution by the new regime in Syria or the Islamist-led transitional government of Ahmed al-Scharaa, nor the Kurdish administration in the northeast.
This decision comes after the Bamf rejected the Syrian's asylum application from October 2023, citing that the situation in Syria had significantly changed with the fall of the Assad regime in December 2024. Prior to this, almost every Syrian had received a protection status almost automatically.
In the entire previous year, there were 79,433 applications from Syrians in Germany. As of the end of August 2025, a total of 18,303 Syrians have submitted an asylum application in Germany.
The court's decision regarding the Syrian's asylum claim confirms the Bamf's decision, which was made in April 2025. The court's decision, however, is not yet final. The applicant can apply for the appeal to be admitted to the Higher Administrative Court.
It's worth noting that the economic outlook for Syria is rather positive, but the search results do not provide information about who made the final decision on the Syrian asylum seeker's application from the Kurdish-controlled area in Syria or when this decision was made.
The court's decision does not indicate that the Syrian is threatened with persecution by the new regime in Syria. The court stated that the applicant could live with his family free of charge. Additionally, the applicant can receive return assistance from Germany to secure his livelihood.
With the changing political landscape in Syria, it will be interesting to see how these decisions evolve in the future. For now, the court's decision stands, and the Syrian asylum seeker will need to consider his options for appeal.
