Supreme Court petition filed by Conor McGregor in quest for another appeal, challenging the court's previous decision in favor of Nikita Hand
In a series of developments, both Conor McGregor and James Lawrence have announced their intentions to appeal rulings made in the civil High Court.
Ms Hand, who had previously sued McGregor for damages, alleging he raped her in the Beacon hotel on December 9th, 2018, is at the centre of this legal drama. An investigation was conducted by the Garda following a referral by Ms Hand's lawyers to the Director of Public Prosecutions (DPP) for consideration of possible perjury, including possible induced perjury by McGregor.
McGregor has filed an application for an appeal to the Supreme Court over the civil High Court jury finding that he assaulted Nikita Hand in a Dublin hotel. His legal team, now represented by Mulholland Law, unexpectedly withdrew new evidence on the morning of the appeal.
During his appeal, McGregor sought to introduce new evidence that would call into question key aspects of Ms Hand's testimony, including how she sustained serious bruising on her body. The court will decide whether the appeal meets the necessary criteria for the court to hear it.
Ciaran Mulholland, solicitor for Conor McGregor, believes the lower courts applied "lip service" in a prejudicial and unfair manner to McGregor's constitutional right. He also stated that there is a necessity for the Supreme Court to clarify the legal points raised in the separate application of James Lawrence.
James Lawrence, who is also being represented by Mulholland Law, has issued separate High Court proceedings against Nikita Hand, alleging a malicious abuse of process. He was not awarded costs despite successfully defending the litigation, a decision that was dismissed by the Court of Appeal (CoA).
Ciaran Mulholland believes the Supreme Court applications raise serious legal issues arising from the CoA judgment of July 31st. He also stated that James Lawrence was wrongfully and unnecessarily dragged through High Court litigation without cause.
A man and woman were arrested and later released without charge in relation to the investigation. A file will be sent to the DPP, but the search results do not provide the names of the persons interviewed by the public prosecutor in connection with the complaint against Conor McGregor.
The statement by Mulholland Law indicates that both Conor McGregor and James Lawrence are 'deeply disappointed' by the decisions, now subject of appeal, made in the lower courts. The High Court proceedings against Nikita Hand are 'in their infancy,' according to the statement.
This ongoing legal saga continues to unfold, with both McGregor and Lawrence seeking to overturn decisions made in the lower courts. The Supreme Court will now decide whether to hear their appeals.
