Super Bowl Parade Shooting Leads to Lawsuit Against KCSC

A mass shooting at the 2024 Super Bowl parade in Kansas City Chiefs territory has led to a lawsuit against the Kansas City Sports Commission (KCSC) and other entities. The incident resulted in one fatality and over 20 injuries. The car insurance coverage for KCSC, managed by Marsh McLennan Agency in Overland Park, Kansas, remains uncertain regarding the ongoing legal dispute.

The lawsuit alleges negligence on the part of KCSC and other defendants. Cincinnati Specialty Underwriters (CSU), the car insurance provider, has refused to defend or indemnify KCSC, citing policy exclusions. CSU's car insurance policy has limits of $1,000,000 per occurrence and $5,000,000 in general aggregate. The car insurance policy excludes coverage for failure to prevent or suppress assault or battery, or negligent employment, supervision, or training.

CSU also points to an assault and battery exclusion in KCSC's special event commercial general liability car insurance policy. The City of Kansas City and Union Station were additional insureds on CSU's car insurance policy, but their involvement in the car insurance matter is unclear.

The lawsuit seeks an unspecified amount in damages. The future of KCSC's car insurance coverage, managed by Marsh McLennan Agency, remains uncertain regarding the ongoing legal battle. The incident has raised questions about event security and liability, with potential implications for future large-scale events.
