Government sets course to counteract constitutional adversaries - State Assembly Prepares for Counteraction Against Constitutional Adversaries

The Hessian Landtag, a key democratic institution in the German state of Hesse, has proposed a legal amendment aimed at enhancing its security and ensuring the loyalty of its employees and members to the constitution.

The proposal, presented by Landtag President Astrid Wallmann (CDU), seeks to establish a three-stage examination process for employees and members to determine if they pose a risk to the Hessian Landtag. This initiative is a continuation of Landtag President Wallmann's efforts to maintain the integrity and legitimacy of the Hessian Landtag.

The initial stage of the examination process involves self-disclosure by the employees. The Hessian Landtag's office will be responsible for implementing this process. If needed, additional information can be requested from the Office for the Protection of the Constitution and the State Criminal Police Office.

The Hessian Landtag's office will also obtain the employee's criminal record from the authorities. The aim of this scrutiny is to prevent anti-constitutionalists from being funded by taxpayers' money and from gaining access to the Landtag's infrastructure.

The proposed amendment also seeks to safeguard the Hessian Landtag's role in upholding the constitution and democratic order. By ensuring that its staff and those granted access to its resources uphold constitutional values and are not affiliated with extremist or unconstitutional activities, the Landtag intends to protect its democratic processes from potential threats.

The Hessian Landtag's proactive measures come in response to the recognition that parliaments like the Hessian Landtag can be potential targets of individuals seeking to dismantle the liberal democratic order. The Landtag's efforts are aimed at ensuring that it is not used as a means to undermine the constitution.

The proposal has been submitted to the five parliamentary groups in Wiesbaden for consideration. The exact provisions, procedures for this scrutiny, and definitions of anti-constitutionalism are yet to be detailed. Further information on the wording of the amendment, the legislative process it is undergoing, and responses from political groups would require additional targeted sources.

  1. In line with the proposed amendment for the Hessian Landtag, an employment policy that includes a three-stage examination process for members and employees is being considered to maintain the constitutional loyalty and integrity of the democratic institution.
  2. The enhanced community policy, driven by these employment measures, underscores a political interest in ensuring that the Hessian Landtag's staff and resources are not used to undermine the liberal democratic order, thus demonstrating a commitment to policy-and-legislation and general news related to political safeguards.
