Senate deliberation over the Automatic Transfer of Notification (ATN) law regarding the mandatory delivery system

The Senate in Argentina is currently in session to discuss the automatic distribution of ATN (National Emergency Assistance) funds, following the rejection of the presidential veto by the Chamber of Deputies on September 18.

The bill for the automatic ATN distribution was submitted by national deputies Carlos Heller and Mónica Macha. The Senate session was convened by Vice President Victoria Villarruel.

The objective of the automatic ATN distribution is to redirect resources towards an automatic distribution scheme according to the general coparticipation coefficients. This proposed change is outlined in a decree published by the Executive Branch on September 11.

The current distribution of the National Treasury Contributions Fund to the Provinces, regulated by Federal Revenue Sharing Law No. 23548, is done discretionarily by the central executive. However, the automatic ATN distribution law aims to replace this discretionary approach with a more systematic distribution method.

The decree published by the Executive Branch also states that the automatic ATN distribution law alters the legally assigned purpose of the National Treasury Contributions Fund and deprives the national state of an immediate action tool against emergencies and financial imbalances.

During the Senate debate, the opposition criticized Javier Milei's veto, accusing him of wanting to overthrow the President and recover his business. Despite this, the Senate is heading towards rejecting another veto from Milei and ratifying the ATN law.

The automatic ATN distribution law proposes the incorporation of an article to Law 11,672 (Permanent Budget Law) to automatically coparticipate the ATN Fund according to the formula of Law 23,548 of Coparticipation. This move is intended to ensure a more equitable distribution of funds among the provinces.

The Senate's decision on the automatic ATN distribution law is eagerly awaited, as it could mark a significant shift in the way emergency funds are distributed in Argentina.
