A care home place doesn't simply get cancelled. Yet, it unwillingly happens sometimes. And if it does, it's not an immediate acceptance for those affected.

Finding the perfect care home for seniors can be quite a challenge in Germany. Once a resident settles in, concerns usually dissipate. But it's important to remember: a care home cannot be cancelled haphazardly. Nevertheless, some cases of extraordinary cancellations have been reported in care homes, as shared by the Berlin Consumer Center recently. So, what can those affected do?

For an extraordinary cancellation, there ought to be a valid reason that makes it unreasonable for the operator to proceed with the care contract, considering all the circumstances and the interests of all parties involved. The requirements for this reason are quite stringent.

Care homes may justify an extraordinary cancellation by stating that they can no longer provide care or that the resident is unsuited for the home. For instance, if a resident with dementia becomes aggressive.

But "most of the time, this isn't enough," says Isabell Jandl, a lawyer at the Berlin Consumer Center. Consequently, such cancellations can usually be challenged. If unsure, residents can seek legal assistance, such as from a consumer center or a specialist lawyer.

Remember, a care home's cancellation of residents is only legitimate in exceptional circumstances. Therefore, don't take it lying down; it's always worth standing up for your rights. There's no such thing as an "ordinary" cancellation by care home operators. Only written cancellations with a valid reason are acceptable.

Paying Late Can Lead to Cancellation

This occurs if the operation is closed down or if the home can't offer professional care due to a health change and has explicitly accounted for this case. Or, if a resident continually fails to comply with a contract amendment to match the increased care requirement.

Payment default for at least two months, with a reasonable deadline set by the operator that goes unmet, is also acceptable. However, a company cannot cancel the contract to enforce a fee increase. Also, if a resident persistently and willfully ignores the rules laid down in the care contract, the company may cancel the contract without a deadline.

Important to note: for a valid cancellation, continuing the care relationship must become an unbearable burden for the company. Often, this is claimed but seldom valid. Constantly ringing the bell or having a high care requirement won't suffice.

Residents have the right to cancel their care contract without providing reasons. This can be done up to the third working day of the same calendar month.
