In a legal tussle, the BfV is pressing pause on their public labeling of the AfD as an undeniably far-right movement. The party's legal team is not taking this sitting down. This prolonged dispute seems inevitable.

Clash in the Courtroom

The Federal Office for the Protection of the Constitution (BfV) has initiated a temporary legal standstill in their public assessment of the AfD. In a letter to the administrative court in Cologne, the authority acknowledged this move to halt public characterizations of the AfD as an undisputed far-right outfit[1]. This ascension comes after the AfD challenged the BfV's classification.

In response to inquiries, the court confirmed receiving the correspondence from the authority. Though the BfV remains mum on the matter, citing the ongoing nature of the legal proceedings and respect for the court[1].

This isn't the first time the BfV has adopted such an approach. It resorted to the same tactic in January 2021 when the AfD contested its previous label as a "suspicious case." Ultimately, their lawsuit was unsuccessful on two accounts[1]. The ruling of the Higher Administrative Court of Münster remains unenforced.

A Legal BattleThe temporary legal standstill doesn't just prohibit public declarations but also restricts the BfV from viewing the AfD as an undisputed extremist group until a final verdict is reached[1]. In 2022, it ruled on the classification of the AfD as a "suspicious case" - and the decision was upheld[1].
