In the heart of Berlin, a legal battle is unfolding between the owner of a building, Lukas Hufnagl, and the Alternative for Germany (AfD) party. The dispute stems from a lease termination in March 2025, following an election celebration held by the AfD in the inner courtyard, which was not approved.

The building in question, which houses the AfD's Federal Business Office in Berlin-Wittenau, has been rented from Hufnagl since 2022. Negotiations for the sale of the building took place but were unsuccessful, with the sale set to occur before or around early 2025. The termination of the lease was a result of disputes including unauthorized events and alleged implicit bribery demands by the party during purchase talks, claims that the AfD denies.

Each lease agreement for the property, originally set to expire at the end of September, November, and December 2027, respectively, comes with a special cancellation right that would shorten the rental period by one year. However, the court did not address these specific details during the proceedings.

The main hearing, presided over by Judge Niebisch, began immediately after a conciliation hearing between Hufnagl and the AfD representatives ended in failure. The judge acknowledged that the AfD violated the contract by holding the election party in the courtyard, but also stated that a warning should have been issued beforehand.

The judge did not delve into the alleged blackmail attempt by the AfD during the purchase negotiations. The AfD offered to move out by October 30, 2026, and pay a six percent rent increase, a proposal that was deemed laughable by Hufnagl.

The facade of the building was illuminated in blue with the AfD logo, an action that was not approved. The court case is ongoing, with a resolution yet to be reached.
