German Court Halts Probation Over Deadly E-Scooter Crash

Take a seat. Recently, the Saarbrücken Regional Court handed down a sentence of probation—and a hefty fine—to a 46-year-old for causing a fatal E-scooter crash that took the lives of two teenagers. But the verdict isn't final yet. The incident occurred back in June 2023, leaving a 16-year-old boy and a 17-year-old girl dead.

Through his lawyer, the driver expressed his remorse over the tragic event. Allegedly, the driver was traveling at an appaling 65 to 71 kilometers per hour in the Saarbrücken city center at 23:00, blatantly disregarding the 20 km/h speed limit. The girl on the E-scooter and her companion, also riding the scooter, entered the intersection while the light was red, resulting in a collision with the vehicle. An expert's analysis concluded that the accident could've been prevented altogether.

The Ugly Impact of Negligence on Germany's Roads

In Germany, negligent homicide is a severe offense under the country's road safety laws. The maximum penalty for negligent homicide ranges from six months to five years in prison, depending on the severity of the circumstances. Moreover, offenders may also be liable for fines that can be substantial.

  • Fines: Sometimes, the court imposes fines to discourage drivers from engaging in reckless behavior. The magnitude of these fines can be substantial and may be proportionate to the offender's income.

  • Exacerbated Punishments: Negligent homicides involving driving under the influence can lead to more serious penalties. Germany's strict laws limit blood alcohol concentration (BAC) to 0.5‰ for experienced drivers and 0.0‰ for novice drivers and those under 21.
