The judge, William Alsup of California's San Francisco, stated that the use of "poor performance" as a dismissal reason was a deceit to skirt legal obligations, according to The New York Times.

Alsup ordered the Department of Finance, Defense, Agriculture, Energy, Interior, and Veterans Affairs to reinstate those improperly fired. Alsup made this decision following a lawsuit by unions. "It's bleak when our government terminates a competent employee and uses poor performance as an excuse - even when they're fully aware it's a lie," the judge said.
