Tension Surrounds AfD Party Meeting as a Potential Lawsuit Threatens - Purported AfD gathering nearing - legal action imminent
In a surprising turn of events, the Alternative for Germany (AfD) party has announced its intention to take legal action against the municipality of Hechingen and the administrative court, following the cancellation of their planned state party conference at the city hall.
The AfD party, which is expected to have over 400 delegates at their conference, had originally planned to hold the event in Hechingen's city hall on November 9th. However, the city council, in a meeting marked by a majority vote of 23 in favour and 5 against, approved a new usage regulation for the hall, prohibiting federal or state party events from October onwards.
The AfD party, who have a signed rental contract with the city for the conference, has assumed that the city upholds concluded contracts and that a change in the purpose of public institutions does not have retroactive legal effect. They believe that the new regulations violate their contractual rights.
The AfD party co-state chairman, Emil Sänze, has stated that this issue is a problem of a general nature and needs to be prevented from happening in the future. He also emphasised that the party aims to clarify the issue in principle, not just for their specific case, and will likely file their legal challenge in the administrative court (Verwaltungsgericht) to ensure the use of the Stadthalle in Hechingen for their party conference.
This is not the first time the AfD state association has encountered resistance and cancellations in finding a location for a party conference. In the past, they have held several events in the Hechingen city hall without any problems. The new rules for the city hall state that it is a public institution to promote cultural, social, and political life in the city and can be used for municipal political events upon request.
The AfD party conference in Hechingen is also significant as it aims to decide on their program for the upcoming state elections in Baden-Württemberg. The state board of the AfD will also attend the conference in Hechingen.
