Weinstein's Case Remains in Limbo as Retrial Possibility Looms
Harvey Weinstein's legal saga continues as Manhattan prosecutors prepare for a potential third trial, this time for a rape charge involving actress Jessica Mann.
Current Status
Weinstein was convicted in June 2025 of forcing oral sex on Miriam Haley in 2006. However, the jury could not reach a verdict on a rape charge involving Mann in 2013. He was acquitted of another sexual assault charge involving Kaja Sokola.
Mann has agreed to testify again in the potential new trial. Weinstein's lawyers are not willing to plead guilty to the rape charge involving Mann but have not ruled out the possibility of reaching a deal to resolve the case.
Potential Timeline
A sentencing hearing is scheduled for September 30, but this will only proceed if there is no retrial on the Mann charge. If there is a retrial, it is likely to happen this fall. Prosecutors initially requested a January trial date, which was deemed too far away by the judge.
Both prosecutors and Weinstein's lawyers are preparing for another trial, which would be his third in New York and fourth overall. The newly elected Democrat has advocated for Weinstein to be retried for the rape of Jessica Mann.
The highly publicized #MeToo case of Weinstein may return to court in the fall, as Manhattan District Attorney Alvin Bragg is in the midst of a re-election campaign. Judge Farber proposed that the trial take place in the fall.
