Senate's left-wing critic, Heike Sudmann, pointed out the Senate's inability to combat rampant rent increases effectively. In her opinion, expropriating profit-driven housing firms could significantly improve tenants' situations. However, Sudmann accused the Senate of preferring 'cuddly' arrangements with the housing industry and 'windy' investors. She perceived the appeal to the court as an attempt to divert attention from the Senate's shortcomings.

The Senate's primary concern lies in the initiative's legality under Hamburg's Constitution, as it involves expropriating significant housing companies, and its impact on higher-ranking laws must be clarified.
