Harvey Weinstein Faces Possible Retrial for Rape Charge in New York City
Harvey Weinstein, the disgraced Hollywood producer, is facing a potential retrial this fall for a rape charge in his New York City sex crimes case. The charge in question involves allegations by Jessica Mann that Weinstein raped her in 2013.
The previous jury deadlocked and could not reach a verdict on this charge. Prosecutors have expressed readiness to proceed with a third trial on this charge, which carries a possible sentence of up to four years in prison. If the trial occurs, Weinstein's sentencing, currently scheduled for September 30, will be postponed until the entire case—including the retrial—is resolved.
Weinstein was previously convicted in June 2025 of forcibly performing oral sex on Miriam Haley in 2006, a charge carrying up to 25 years in prison. However, he was acquitted of a similar charge involving Kaja Sokola. The unresolved rape charge related to Jessica Mann prevents immediate sentencing until it is addressed either by retrial or other resolution.
Manhattan Judge Curtis Farber has proposed having the trial in the fall. Arthur Aidala, Weinstein's lawyer, stated that it's on prosecutors to resolve the rape charge. Manhattan District Attorney Alvin Bragg is resolute in wanting to retry Weinstein on this charge.
Bragg expressed satisfaction with Weinstein's conviction on a criminal sex act charge in the Miriam Haley assault. He stated, "The jury was not able to reach a conclusion as to Ms. Mann, and she deserves that." Bragg emphasized that the work is about the survivors and they are prepared to go forward with the trial.
If a fall trial happens, it could potentially put Weinstein's high-profile #MeToo case back in court during Manhattan District Attorney Alvin Bragg's reelection bid. Weinstein denies all of the allegations against him. He has also been convicted of sex crimes in California.
Aidala didn't rule out the possibility of reaching a deal with prosecutors to end the case. However, it seems that both parties are prepared for a trial, with Mann willing to testify again. The exact trial date for the Mann rape charge remains unresolved, leaving Weinstein's possible Sept. 30 sentencing in limbo.
