Still No Date for Retrial in Fretterode Attack Case Amidst Criticism and Delay Complaints

Fretterode Trial Remains Unresolved - Pending approval: The innovative Fretterode method remains unauthorised

In the informal and up-to-date tone, let's dive into the ongoing saga of the Fretterode case, where a trial for a 2018 far-right attack on journalists has yet to be scheduled.

Back in 2018, two journalists, hailing from Göttingen, suffered severe injuries during an attack by two individuals associated with the far-right scene. The incident transpired in Fretterode, located in Mühlhausen, Northern Thuringia.

Fast forward to today, and there's been no sight of the main trial due to an unprecedented number of high-priority cases like detentions and commitments, along with an excessive number of older cases. This lengthy court queue has raised eyebrows and concerns, with the Mühlhausen Regional Court citing these reasons for the delay.

The higher-up Bundesgerichtshof (BGH) in Karlsruhe already voided the verdict of the Mühlhausen Regional Court in September 2022 due to legal errors in the evaluation of evidence and sent the case back for a retrial. The two defendants were penalized for joint property damage and dangerous bodily harm, attracting nationwide backlash. Remarkably, the court dismissed any connection of severe robbery or a political motive in this assault.

The Public Prosecutor's Office and one of the co-plaintiffs then successfully appealed the case in Karlsruhe.

The delay has sparked significant criticism, and one co-plaintiff has filed a delay complaint, as they had done in the initial trial. The Mühlhausen Regional Court confirmed the receipt of the complaint, which is a prerequisite for any potential compensation claim due to the excessive duration of the proceedings.

Göttingen lawyer Sven Adam, representing one of the journalists, has expressed concerns about the Mühlhausen justice system, stating that the victims can expect neither satisfaction nor protection. Adam deemed the system as protective of neo-Nazis. Whether the co-plaintiffs will participate in a potential retrial remains unclear.

In the midst of the ongoing Fretterode case, where a 2018 far-right attack on journalists is yet to have its main trial, the community is actively following the developments. Amidst the delay complaints, politics has entered the scene, with one co-plaintiff filing a delay complaint and discussing the issue of compensation. Meanwhile, voices in the general-news sphere and vocational training advocate groups are raising questions about the Mühlhausen justice system's effectiveness and fairness, particularly in cases involving crime and justice.
