The BSW, once shot down in Karlsruhe with a couple of constitutional complaints against the Bundestag, found their claims inadmissible concerning the federal election law design. They cried foul over the lack of a legally secured appeal mechanism if they barely miss the five percent threshold. The party also criticized the order of parties on ballot papers. Sadly, they couldn't make it to the Bundestag parliament with 4.98 percent in the election.

Now, they're saying the Federal Constitutional Court didn't rule whether they're entitled to a recount, according to Mohamed Ali. It did, however, establish that they can file a constitutional complaint regarding the election if the Bundestag's electoral review committee ignores their complaint past a reasonable timeframe. "It's a joke that this committee isn't even formed yet," AFP, BSW's chairwoman, quipped.

BSW insists that, based on their research, they'd probably be in the Bundestag if given a do-over, according to Mohamed Ali.
