Title: Reconsidering Thalidomide Foundation's Decision on Benefits Claim

Following a ruling by the Higher Administrative Court of Münster, the Contergan Foundation in Cologne must reconsider a man's application for benefits. Born in 1960, the plaintiff had previously attempted to secure support from the foundation in 2011, but was unsuccessful due to several physical injuries. The court found that the decision-making procedure for his claim had not been followed properly.

The ruling highlighted that only some, not all, members of the Foundation's Medical Commission had been involved in the original case. Consequently, the Foundation is now required to examine the man's application again. Importantly, this decision is not legally binding.

The Contergan Foundation, established to address damages caused by the infamous over-the-counter sleeping pill Thalidomide, currently provides pensions to approximately 2,300 victims. Their mothers had taken the drug during pregnancy, resulting in severe physical impairments to their unborn children.

As the case demonstrates, proper procedures need to be adhered to when handling pharmaceutical damage cases, such as Thalidomide. Given the far-reaching implications of pharmaceuticals, it is essential to maintain a fair and transparent process in these cases.

In terms of re-evaluating the man's application, the Contergan Foundation should:

  1. Re-examine all relevant medical records and documentation.
  2. Ensure all medical commission members are part of the re-evaluation process.
  3. Consider obtaining an independent medical assessment if necessary.
  4. Maintain detailed documentation throughout the re-evaluation process.
  5. Thoroughly consider the man's condition in terms of economic and non-economic losses.
  6. Seek legal advice should any disputes or compliance concerns arise.

By following these measures, the Contergan Foundation can demonstrate its commitment to fairness, transparency, and comprehensive evaluation in addressing the impacts of pharmaceutical damage cases.
