In a shocking turn of events, the Thai Constitutional Court has removed Prime Minister Paetongtarn Shinawatra from office on 29 August 2025. The decision was made due to a scandal involving a leaked phone call between Paetongtarn and Cambodia's de facto leader, Hun Sen.

The phone call, released by Hun Sen on 18 June 2025, caused controversy due to Paetongtarn's perceived closeness to Hun Sen. The conversation reportedly involved a request to reopen a disputed border, a matter of significant concern given the almost 800-kilometer border between Thailand and Cambodia, much of which is poorly demarcated and subject to frequent territorial disputes.

Paetongtarn's removal raises concerns about excessive uncertainty for elected representatives, as it potentially enables courts to arbitrarily remove politicians on flimsy grounds. This decision may make it more challenging for incoming governments to appoint new cabinet members or introduce controversial policies due to unrealistic demands for overly pure and clean politics.

The red line between political and ethical liability remains blurry, contributing to the turbulence in Thailand's moralistic politics. This case highlights the difficulties in defining ethical standards for politicians, given the diverse views of what constitutes good and ethical behavior. Failure to comply with these standards can result in removal from office and a lifetime ban from politics.

It is important to note that Paetongtarn is the daughter of controversial former Thai Prime Minister Thaksin Shinawatra. Her case is not the first instance of a political leader facing scrutiny over ethical conduct. In 2014, her aunt, Yingluck Shinawatra, was involved in a similar situation with the rice pledging scheme. She was punished for failing to prevent her deputy and civil servants from seeking profit from the scheme.

The case against Paetongtarn blurs the line separating legal and political liability, as her actions remained within legal boundaries but faced criticism for perceived unethical behavior. The Constitutional Court ruled that while Paetongtarn was actively trying to solve a border crisis, her actions undermined Thailand's position and violated serious ethical standards due to her perceived subservience to Hun Sen.

This decision opens a debate about the blurry line between political and ethical liability. The 2017 Constitution of Thailand, drafted under the junta, includes provisions for ministers to be evidently honest and to not seriously fail to meet ethical standards. However, the interpretation and application of these standards remain a contentious issue in Thai politics.

The removal of Paetongtarn from office may have long-term effects on the originality and adaptability of politicians in Thailand. It serves as a reminder of the importance of maintaining high ethical standards in politics and the potential consequences of failing to do so.

In a related development, the Constitutional Court removed Paetongtarn's predecessor, Sretha Taweesin, in 2024 for appointing a morally questionable candidate, Pichit Chueuban, who was sentenced to six months' imprisonment for contempt of court 15 years ago, in a case related to Paetongtarn's father, Thaksin Shinawatra. This decision underscores the court's commitment to upholding ethical standards in Thai politics.

As the political landscape in Thailand continues to evolve, the removal of Paetongtarn from office serves as a significant milestone, highlighting the need for clear and consistent ethical standards in Thai politics.
