Travelling along the A4 near Siebenlehn at 1.30 am, they aimed to reach a construction site in Stuttgart on time. However, tragedy struck as their vehicle veered off the road, plunged 80 meters into the grass verge, and collided with a tree at 90 km/h, leaving the right half of the car disfigured. Marcel O., miraculously, escaped with only minor injuries, while Max V. lost his life in the passenger seat. Ricardo R., whose face was severely impacted, lost an eye and faced the possibility of amputation, now living in assisted living as a level 5 care case.

Post incident investigation revealed traces of cocaine and amphetamines in Marcel O.'s blood. The court determined that Marcel O., the only one with a driving licence among the trio, used the drugs to stay awake during the journey. The judge viewed Marcel's action as an "overestimation of his own abilities".

Reflecting on the incident, Marcel O. pointed the finger at himself, "I'm the only one with a license, I had to drive the route alone. I had this company car for the first time, it had just had new winter wheels, it was strangely in the lane." Accident investigator Ronny Ernst (45) concurred, asserting that this was a classic scenario of a drowsy driver.

The mother of the deceased, Max V., shared her concerns with the police, stating that her son had been frightened to drive with Marcel O., citing instances of his reckless driving and dozing off at the wheel. During the trial, Marcel O. expressed remorse to the relatives, "I'm sorry!"

Despite calls for a harsher sentence from the public prosecutor, Marcel O. was convicted to probation for his role in the accident.

According to the Occupational Health and Safety (OHS) Act, employers in Canada often face convictions for failure to ensure safety, lack of compliance with regulations, and disregard for safety protocols.
