Former Tennis Star Boris Becker Wins Cease-and-Desist Lawsuit Against TV Comedian Oliver Pocher
In a significant ruling, the Federal Court of Justice (BGH) has confirmed that TV comedian Oliver Pocher is no longer allowed to distribute controversial image sequences from the RTL show "Pocher - dangerously honest." The case, which involved images from the show, was initially ruled in Becker's favour by the Higher Regional Court of Karlsruhe in November 2023.
The dispute arose after Pocher received a three-digit euro amount as a supposed fashion prize in the show, unaware that it was actually a donation. An appeal for donations was started under the slogan "Make Boris rich again," which sparked the legal action.
Becker, the former tennis star, has won his cease-and-desist lawsuit against Pocher. The money from the donation appeal was hidden in the supposed fashion prize, a fact that was central to Becker's claim.
Pocher's complaint against the non-admission was rejected by the BGH. Boris Becker was victorious in the case at the Higher Regional Court of Karlsruhe, a ruling that has now become final.
Pocher's Hamburg lawyer, Patricia Cronemeyer, is considering filing a constitutional complaint, believing the BGH's decision violates constitutional principles. Cronemeyer states that the decision should be reviewed for legality and correctness.
However, the case did not see an appeal from Pocher at the BGH, and the ruling was confirmed by a spokesperson for the Federal Court of Justice. It is unclear at this time whether a constitutional complaint will be filed.
In the aftermath of the ruling, Pocher was ordered to delete relevant film clips from his own internet presence. The ruling marks a significant victory for Becker in his legal battle against Pocher.
