Nuclear waste transportation still remains unchallenged by the Commission in terms of legality.

In a controversial decision, the planned transportation of nuclear waste containers from Jülich to Ahaus has been approved by the Federal Office for the Safety of Nuclear Waste Management (BSH). The city of Ahaus, however, continues to voice its opposition, having previously unsuccessfully challenged the Castor transports in court.

The Castor transports are designed to transport nuclear waste containers from Jülich to Ahaus, where an interim storage facility will house the 152 Castor containers. The transportation route will pass through populated areas, a fact that has raised concerns among local residents.

Despite these concerns, the authority responsible for the examination and approval of the transport and storage, the Federal Office for the Safety of Nuclear Waste Management (BASE), has deemed the 152 approved Castor transports as not infringing on the city's rights. The operator of the interim storage facility in Ahaus has also been granted permission to store the Castor containers, following the dismissal of lawsuits filed by the city of Ahaus by the Higher Administrative Court.

The city of Ahaus, however, has not indicated any intention to take further legal action against the planned transport of nuclear waste from Jülich. Instead, it has filed an objection with the federal office regarding the further transport and storage of nuclear waste from a location other than Jülich, believed to be Garching near Munich.

The exact number of nuclear waste containers involved in the potential transport from Garching and the distance or route for the transport have not been disclosed. Until the examinations for the transport and storage from Garching are completed, nothing may be transported or stored.

The transport permit for fuel elements from Jülich to Ahaus has not been mentioned in this paragraph. The city of Ahaus had originally opposed the Castor transports, but despite the BSH's approval and the dismissal of their lawsuits, they continue to protest against the Castor transports.
