In a significant ruling on August 11, 2025, the Nevada Supreme Court decided that former Las Vegas Raiders coach Jon Gruden's lawsuit against the NFL will proceed in a public court rather than an arbitration hearing. The 5-2 decision reversed an earlier ruling that had favoured arbitration, blocking the NFL’s attempt to force Gruden into private arbitration and allowing his claims to be heard openly.

Gruden's attorney, Adam Hosmer-Henner, expressed his pleasure with the court's decision, stating that it vindicates Gruden's reputation and clears the way for swift justice. The lawsuit alleges that the NFL engaged in a "malicious and orchestrated campaign" by leaking Gruden's private emails, which contained offensive language including racist, misogynistic, and homophobic content, damaging his reputation and leading to his resignation as Raiders coach.

These emails mostly date from 2010 to 2018, a period when Gruden was working as an ESPN analyst and not employed by an NFL team. The leaks occurred after the NFL found the emails as part of a separate investigation into the Washington Football Team in 2021. The lawsuit was filed after Gruden was coaching the Raiders when the emails were made public.

The NFL has described Gruden’s claims as baseless and holds him responsible for the offensive content in the emails. However, the Nevada Supreme Court's ruling emphasized that doctrines like equitable estoppel cannot bind former employees like Gruden to arbitration agreements designed for current employees. The court did not address the truth of Gruden’s allegations but focused on procedural fairness and the applicability of the arbitration clause.

The NFL has announced its intention to appeal this ruling to the U.S. Supreme Court, so the case's final path remains uncertain. Gruden, on the other hand, has expressed a desire to clear his reputation through this litigation rather than settle quietly. The decision also implies that the NFL could be held accountable for its actions.

The lawsuit maintains that NFL commissioner Roger Goodell was a central figure in the alleged campaign against Gruden. However, the court's decision did not address the role of Goodell or any other individual in the dispute. As of now, the case will proceed publicly, offering a chance for both parties to present their arguments in a public forum.
