June this year, the 73-year-old disgraced movie mogul, standing trial for allegedly raping actress Jessica Mann, faced an indecisive New York jury, resulting in a hung jury and a declared mistrial.

New York will witness a third trial for Harvey Weinstein, following a mistrial on a rape allegation.

Harvey Weinstein, the former film producer known for his work on Oscar-winning films such as Shakespeare In Love, Pulp Fiction, and The Crying Game, is set to face a third trial in New York City. This trial pertains to a rape charge related to hairstylist and actor Jessica Mann, for which a jury previously failed to reach a verdict.

The trial, initially proposed by Manhattan Judge Curtis Farber to take place this fall, was initially requested by prosecutors for a January trial date. The exact date has not been finalised yet.

Weinstein's sentencing for his conviction on forcing oral sex on TV and movie production assistant Miriam Haley in 2006 is scheduled for September 30. However, this will only proceed if there is no retrial on the Mann-related charge. If a retrial occurs, sentencing will be delayed.

Weinstein was convicted in June of criminal sexual assault against Haley and acquitted of another charge involving model Kaja Sokola. The Mann-related charge is punishable by up to four years in prison, which is less than the time Weinstein has already served.

Weinstein's lawyers have indicated they are willing to proceed with another trial, but they are also exploring the possibility of a resolution without a guilty plea on the Mann charge.

Throughout the retrial, Weinstein's lawyers insisted the sexual encounters with his accusers were "transactional" and "consensual." They also labelled the women as opportunists.

It all began in 2017 when a series of sexual misconduct allegations against Weinstein propelled the #MeToo movement. Some of these accusations later led to criminal charges and his convictions in New York and California.

Weinstein has denied all the charges against him in both New York and California. He was originally convicted of rape and criminal sexual act by the same court in New York in 2020 and sentenced to 23 years in prison for the crimes. However, New York's highest court overturned his conviction last year.

Weinstein is a co-founder of film and television production companies Miramax and The Weinstein Company. Despite his legal troubles, he continues to deny all the charges against him.
