New York court to re-trial Harvey Weinstein on rape charges following a recent mistrial
Hollywood producer Harvey Weinstein is set to face a third trial by New York prosecutors in the sexual assault case involving actress Jessica Mann. The retrial, which is scheduled to take place before the end of this year, aims to address an unresolved charge from Mann's case[1][2][3].
Weinstein's legal team has maintained that the sexual encounters with his accusers were "transactional" and "consensual." This stance was present during the previous trial, which ended in a mistrial in June 2025 due to juror misconduct and safety concerns among jurors[1][2][3].
It should be noted that Weinstein was originally convicted of rape and criminal sexual act in 2020 and sentenced to 23 years in prison. However, this conviction was overturned due to procedural issues involving unrelated testimony[1]. Weinstein is currently serving time for a separate 2022 Los Angeles conviction, which he is appealing.
The rape charge from Jessica Mann's case carries a maximum of 4 years, which is less than the prison time Weinstein has already served. Prosecutors are prepared to move forward with the retrial, with Mann expected to testify again[1][2][3].
Unless Weinstein pleads guilty to that charge, prosecutors drop the charge, or the charge is tried before the end of September, Weinstein's sentencing for the guilty verdict in Miriam Haley's case, for which he was found guilty in 2020, will presumably be pushed to a later date[1][2][3].
Weinstein, 73, has consistently denied all of the charges against him.
