Nevada orders Kalshi to address cease-and-desist over sports and elections contracts by specified date

Let's dive into the nail-biting legal tussle between Kalshi, a celebrated financial exchange, and the Nevada Gaming Control Board (NGCB).

Just when the deadline was about to hit, the NGCB granted Kalshi a reprieve last Friday, extending its deadline to respond to a cease-and-desist order. The initial order was issued on March 4, with a deadline of March 14, accusing Kalshi of offering unlawful event-based contracts in Nevada.

In a recent press statement, the NGCB agreed to an extension for Kalshi, allowing for a "limited additional time" to examine the issue at hand. However, the release remains tight-lipped about whether Kalshi will comply with the order or fight back, which argues that the company's activities violate Nevada state law unless it acquires licensing from the Nevada Gaming Commission.

The NGCB's order cites various Nevada Revised Statutes and Nevada Gaming Commission regulations that Kalshi is flouting, and warns of potential criminal consequences.

Interestingly, the order also specifically addresses event-based contracts related to elections. It points out that even licensed sports pools in Nevada are forbidden from accepting wagers on election outcomes.

The demand letter, signed by NGCB Chairman Kirk Hendrick, emphasizes that past violations of Nevada gaming laws may still be subject to both criminal and civil penalties. Any future violations will be treated as willful ones.

Hendrick reiterated, "Every sports pool in Nevada must undergo a rigorous investigation before being licensed, must comply with stringent regulations once licensed, and must pay all applicable taxes and fees. Any attempts to bypass Nevada's gaming regulations will be met with the full weight of criminal and civil penalties."

Note: As of now, there's no clear evidence that Kalshi has been offering election wagering contracts in Nevada. The ongoing legal dispute primarily revolves around sports-related event contracts.

Catchup: Kalshi managed to secure a preliminary injunction from the US District Court for the District of Nevada, which temporarily blocked the NGCB's efforts to enforce state gaming regulations against Kalshi.

Bonus Fact: Kalshi pockets federal regulatory approval to keep operating in Nevada despite ongoing legal challenges from numerous states like New Jersey, Illinois, Maryland, Montana, and Ohio.

The legal dispute between Kalshi and the Nevada Gaming Control Board (NGCB) revolves primarily around sports-related event contracts, specifically event-based betting in sports. The NGCB issued a cease-and-desist order to Kalshi, accusing them of offering unlawful event-based contracts in Nevada, while Kalshi argues that their activities fall under sports-betting, which is yet to be licensed by the Nevada Gaming Commission.
