Pub's left-wing autonomist dispute endures another loss? - Multiple losses in the scuffle at the progressive-leaning watering hole?
The legal battle over the illegal left-autonomous pub, Kadterschmiede, in Berlin-Friedrichshain, continues to unfold in the city's courts. The current case is being examined by Judge Sebastian Pörschke at the regional court.
The operators of the pub have been using the premises without a lease since late 2013, residing in the side wing of the partially occupied building complex "Rigaer 94". The property company, based in England, is trying to evict the pub, having requested search warrants in view of the court proceedings.
A large police operation, involving around 200 officers, took place at the building approximately three weeks ago. This operation was conducted to identify the current residents of the building, as the property company is also pursuing eviction lawsuits against house residents parallel to the trial against the pub operators.
The dispute over the admissibility of the landlord's new eviction lawsuit has been a point of contention in the latest hearing. Judge Pörschke has expressed doubts about its admissibility. However, he has also expressed that eviction claims could be justified, once the lawsuit is declared admissible.
In an earlier proceeding, the then responsible 59th chamber of the regional court dismissed the landlord's lawsuit as inadmissible. The Court of Appeals made a decision in summer 2024, confirming this decision, stating that the company is authorized to act and bring legal action due to its administrative seat in England.
Despite the ongoing legal proceedings, a first decision in the eviction lawsuits against house residents is expected in early October. The judge will announce his decision on the case against the pub operators on 8 October at the regional court. The search results do not provide the name of the lawyer representing the Kadterschmiede in the current legal case in Berlin-Friedrichshain.
As of now, there are 13 pending proceedings in the case, making it a complex and ongoing dispute. The community surrounding the Kadterschmiede continues to follow the developments closely, with hopes for a resolution that respects the unique character of this autonomous pub in the heart of Berlin.
